1. INTRODUCTION
1.1. By placing an order with West and Wales Decorating Centres Ltd trading as BRWSH (“BRWSH”), you agree to these Terms & Conditions.
1.2. Please read them carefully each time you purchase. We may update them and will show the publish date above.
1.3. Your statutory rights as a consumer are not affected.
2. DEFINITIONS
“Customer” means the purchaser named on the order; “Consumer” means a Customer buying for personal/domestic use; “Trader” means a Customer acting in business; “Contract” means the agreement for sale of Products incorporating these Terms; “Price” means the price confirmed by BRWSH; “Products” means paints and decorating goods supplied by BRWSH; “Order” means an order placed in-store, by phone or by email; “Product Data Sheet” means manufacturer documentation (technical/safety/application guidance); “Site” means www.brwsh.co.uk. “BRWSH”, “we”, “us” means West and Wales Decorating Centres Ltd (11987819), registered office: Jumaro, Gwbert, Cardigan, SA43 1PP; VAT 325 6141 17.
3. BASIS OF CONTRACT
3.1. Descriptions and prices may change before a Contract is formed. If an item is mispriced we may cancel and refund.
3.2. A Contract exists when we (i) accept your Order and (ii) receive full payment (or first agreed instalment) and/or (iii) dispatch/hand over the Products.
3.3. UK law (England & Wales) and the English language apply to the Contract.
4. ORDER PROCESS
4.1. Orders can be placed in-store, by telephone or email. You must be 18+; we may request proof of age.
4.2. We will send an Order Confirmation (for phone/email orders). Please check and report changes within 1 hour; changes may affect Price and lead times.
4.3. For specialist/industrial coatings, contact our team for technical advice. By ordering such Products you confirm you have read the relevant Product Data Sheets and have the competence to use them. We may decline Orders at our discretion.
5. PRODUCTS, COLOURS & DATA SHEETS
5.1. On-screen colours vary. Always check physical colour cards or buy a sample first.
5.2. Before ordering you agree to read the latest Product Data Sheet. We can provide or signpost this on request.
5.3. Availability: if an item is out of stock we will refund or agree an alternative.
5.4. Always test a trial area before full application.
6. PRICE & PAYMENT
6.1. Prices generally include VAT unless stated otherwise.
6.2. Payment is due before collection or delivery, unless we agree trade credit terms.
6.3. Payment methods: card in store, bank transfer, or secure payment link (Stripe/Braintree/PayPal).
6.4. If you do not pay on time we may suspend supply, charge interest and costs under the Late Payment of Commercial Debts (Interest) Act 1998, or terminate.
7. DELIVERY & COLLECTION
7.1. Risk passes on delivery/collection. Delivery to you or your carrier counts as delivery.
7.2. Dates are given in good faith and are not guaranteed. Do not book contractors until all goods are received and checked.
7.3. Report damage/shortage within 24 hours of delivery; preserve goods/packaging for inspection.
7.4. Deliveries usually require a signature. If missed, follow the courier card to rearrange.
7.5. Undeliverable items returned to us may incur redelivery charges.
7.6. Offshore/remote deliveries: surcharges and longer times may apply; local taxes/duties are payable by the receiver.
7.7. If you select Store Collection, collect within 5 days of notification. Failure to collect may lead to cancellation and deduction of reasonable storage/administration costs.
7.8. Lost/denied-receipt parcels are handled under the courier’s terms; replacement/refund is issued once loss is confirmed by the carrier.
8. TINTING & COLOUR MATCHING
8.1. Tinted/specially mixed colours are bespoke and non-returnable unless faulty. Visual matches to third-party colours are by eye/best endeavour.
8.2. Ready-mixed colours may differ from tinted equivalents and from previous batches. Buy a tester if exact replication is essential.
8.3. In a colour dispute you must return all tins for manufacturer analysis. Any remedy follows the manufacturer’s findings and is limited to the cost of the goods; no labour or consequential costs are covered.
9. CANCELLATION & RETURNS
9.1. Traders: cancellations require our written consent. If accepted, goods must be unopened, returned at your cost within 14 days; a 20% restocking fee may apply; delivery charges are non-refundable.
9.2. Consumers: you may cancel standard (untinted) items within 14 days of delivery/collection. Return at your cost within 14 days of notice; we refund the Product price and, if the whole order is returned, the standard delivery charge. Deductions may be made for missing/damaged items.
9.3. Exclusions: no cancellation for (i) tinted/bespoke products, (ii) sealed items unsealed for health/handling reasons, (iii) professional-use-only products where prohibited by BCF guidance.
9.4. We may cancel if stock is insufficient, address is not serviceable, payment is not received, age cannot be verified, or pricing was erroneous. Refunds are made within 30 days; no further compensation is due.
10. CONSUMER NOTICE
Some products are professional use only. We cannot sell such products to Consumers. If you order them in error, you are liable for any resulting costs/fines.
11. DEFECTS & REMEDIES
11.1. Consumers: Products will be of satisfactory quality and fit for purpose. Traders: we use reasonable endeavours to ensure the same.
11.2. Notify defects/missing items promptly (and within 24 hours where reasonably detectable).
11.3. Our remedy is repair/replacement or refund within a reasonable time. For Traders, this is the sole remedy. Keep products for inspection/collection where applicable.
11.4. Nothing limits liability that cannot be limited by law.
12. PRIVACY & DATA
We process personal data per our Privacy Policy and Cookie Notice (see Site). Card details are processed securely via Stripe/Braintree/PayPal; we do not store full card data.
13. DISCLAIMER
We are not liable for loss/injury caused by failure to follow Product Data Sheets, wear PPE, ventilate, or prepare/apply correctly; or for reliance on information inconsistent with the manufacturer’s documentation; or for variance in coverage due to substrate/texture/application.
14. FORCE MAJEURE
We are not liable for delays/failures beyond our reasonable control (e.g., courier failure, supply issues). We may suspend or cancel where our ability to supply is materially impaired.
15. TERMINATION
We may suspend or terminate if you breach the Contract (including non-payment), become insolvent, or we reasonably suspect such events.
16. RISK & TITLE
Risk passes on delivery/collection. Title passes when we receive full cleared payment. Until title passes, store goods safely and do not use them; we may enter premises to recover unpaid goods.
17. LIMITATION OF LIABILITY
17.1. Consumers: liability is limited to the price paid except for foreseeable loss directly caused by our breach. We are not liable for decorator/contractor costs or misuse of Products.
17.2. Traders: we are not liable for loss of profit, business, goodwill, or any indirect/consequential loss; liability is capped at the price paid.
17.3. Nothing excludes liability for death/personal injury caused by our negligence or for fraud.
17.4. Always check colour/finish on a test area before full use.
18. COPYRIGHT
Text/images on the Site are copyright BRWSH or the relevant manufacturer. Unauthorised use is prohibited.
19. MISCELLANEOUS
19.1. You may not assign the Contract without our consent.
19.2. Notices must be in writing to the addresses on the Order; deemed delivered as per first-class post or hand delivery rules.
19.3. No waiver of rights by us unless in writing; partial invalidity does not affect the remainder.
19.4. These Terms survive completion to the extent necessary.
